Right of Withdrawal

1. Your right to withdraw

If you are a consumer, you generally have 14 days to withdraw from a distance contract concluded through TakyRace, without giving any reason. The 14-day period runs:

• —for services / championship entries: from the day the contract is concluded;
• —for goods: from the day you (or a third party you indicate) acquire physical possession of the goods.

2. Important exceptions (Art. 59 Codice del Consumo)

The right of withdrawal does not apply, among others, to:

• —digital content not supplied on a tangible medium (e.g. car setups, downloads) where performance has begun with your prior express consent and your acknowledgement that you thereby lose the right of withdrawal;
• —services fully performed where performance began with your prior express consent and acknowledgement that you lose the right once fully performed;
• —goods made to your specifications or clearly personalised;
• —services related to leisure activities for a specific date or period — this covers entry to a championship, race or event scheduled for a specific date, which therefore does not carry a right of withdrawal (as with tickets to dated events).

Where an exception applies, it will be flagged to you before purchase (see the Pre-contractual Information).

3. How to withdraw

To exercise the right, before the 14 days expire, make a clear statement to the seller of your decision to withdraw. You can:

• —use the in-product withdrawal/refund request (where available), or
• —email support@aitaky.com, who will route your request to the seller, or
• —use the model withdrawal form below.

We recommend keeping proof of sending your withdrawal.

4. Effects of withdrawal

If you validly withdraw, the seller reimburses all payments received from you without undue delay and within 14 days of being informed, using the same means of payment you used (via Stripe), unless agreed otherwise. For goods, reimbursement may be withheld until the goods are returned or proof of return is provided; you bear the direct cost of returning the goods unless the seller agreed to bear it.

On a valid withdrawal you receive a full refund of the price you paid. TakyRace returns its 8% platform fee; the non-recoverable EUR 0.25 Stripe fee is borne by the seller and is not deducted from your refund. See the Refund Policy for details.

5. Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract (Annex I(B), Consumer Rights Directive).
