Pre-contractual Information

This summarises the information shown to a consumer before they are bound by a distance contract, based on Art. 49 Codice del Consumo / Art. 6 Consumer Rights Directive 2011/83/EU. It applies to purchases via the TakyRace marketplace.
A. Information shown at checkout
Before a consumer places a paid order (championship/season/race entry, setup, or other goods/service), TakyRace shows clearly and comprehensibly:
- Main characteristics of the goods/service, to the extent appropriate.
- Identity of the seller (the trader running the championship or selling the item) — name and, for traders, geographical address and contact; plus TakyRace / Aitaky SRL as the platform operator (see the Legal Notice).
- Total price including taxes (or the manner of calculation), and all additional fees (including the TakyRace platform fee and any delivery costs); if these cannot be calculated in advance, the fact that they may be payable.
- Payment, delivery and performance arrangements, and the time by which the seller undertakes to deliver/perform.
- Right of withdrawal — conditions, time limit and procedure, with the model withdrawal form; or, where an exception applies (e.g. digital content/setups delivered immediately with consent, or event-specific services), a clear statement that the right does not apply and the consumer's acknowledgement.
- Legal guarantee of conformity for goods/digital content (reminder of the statutory ~2-year guarantee).
- Duration of the contract or, for indefinite/auto-renewing contracts, the conditions for terminating; minimum duration of the consumer's obligations, if any.
- Complaint handling and out-of-court redress (the ODR platform link).
- The applicable terms — links to the Terms of Service, Refund Policy and Privacy Policy.
B. "Order with obligation to pay"
The order button is labelled clearly (e.g. "Order and pay" / "Acquista ora") so the consumer explicitly acknowledges the obligation to pay (Art. 51 Codice del Consumo). If this is missing, the consumer is not bound.
C. Confirmation
After purchase, the consumer receives confirmation of the contract on a durable medium (e.g. email) within a reasonable time, including all the above information and, where applicable, confirmation of prior consent to immediate performance and the resulting loss of the right of withdrawal.
D. Digital content / setups
For setups and other digital content supplied immediately, we obtain the consumer's prior express consent to begin performance and their acknowledgement that they lose the right of withdrawal, and record both.
